These Terms of Service ("Terms") govern your access to and use of the website operated by Mikk Services, LLC ("Mikk Services," "we," "us," or "our") at https://mikkservices.com (the "Site"), and any related services, estimates, quotes, scheduling, and communications ("Services"). By accessing the Site or requesting Services, you agree to these Terms. If you do not agree, do not use the Site or Services.
1. No Professional Advice; Estimates Are Not Bids
Information on the Site is for general informational purposes only and is not professional electrical, engineering, or legal advice. Any pricing, timeline, or scope information shown is illustrative only. All work requires a separate written estimate issued and signed by Mikk Services, LLC. Estimates are valid for 30 days unless stated otherwise and may be revised based on site conditions, code requirements, permits, or hidden conditions discovered during work.
2. Scheduling, Access, and Cancellations
You agree to provide safe, lawful access to the work area and to disclose known hazards. We may reschedule due to weather, safety, supply, or emergency conditions. Cancellations within 24 hours of a scheduled appointment may incur a trip/diagnostic fee.
3. Payment
Payment terms are stated on each estimate or invoice and are due upon completion unless otherwise agreed in writing. Late balances may accrue interest at the maximum rate permitted by Maryland law. You are responsible for collection costs and reasonable attorneys' fees on delinquent accounts.
4. Permits, Inspections, and Code Compliance
Where required, permits and inspections will be obtained and billed at cost plus reasonable handling. Work is performed in accordance with applicable codes in effect at the time of installation. Bringing pre-existing, non-conforming conditions into compliance is not included unless explicitly stated in the written estimate.
5. Warranty
Unless otherwise stated in writing, Mikk Services, LLC warrants its labor on installed work for one (1) year from the date of completion. Manufacturer warranties apply to materials. This warranty does not cover damage from misuse, modification, power surges, lightning, rodents, water, acts of God, work by others, or normal wear. THIS LIMITED WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
6. Disclaimers
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. ANY RELIANCE ON SITE CONTENT IS AT YOUR OWN RISK.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIKK SERVICES, LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US FOR THE SPECIFIC WORK GIVING RISE TO THE CLAIM IN THE 90 DAYS BEFORE THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
8. Indemnification
You agree to indemnify and hold Mikk Services, LLC harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your misuse of the Site, breach of these Terms, or violation of law or third-party rights.
9. Communications Consent
By submitting a request or providing your phone number, you agree to receive calls and SMS/text messages from Mikk Services, LLC related to your inquiry and Services. Reply STOP to opt out of texts. Standard message and data rates may apply. See our Privacy Policy for details.
10. Intellectual Property
The Site, including text, graphics, logos, photos, and the Mikk Services name and tagline, is owned by Mikk Services, LLC or its licensors and is protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
11. Photo & Project Use
Unless you notify us otherwise in writing before work begins, you grant Mikk Services, LLC the right to take and use non-identifying photographs of completed work (excluding personal items and identifying details) for marketing and portfolio purposes.
12. Governing Law & Venue
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Calvert County or Anne Arundel County, Maryland, and you consent to personal jurisdiction there.
13. Severability & Entire Agreement
If any provision is held unenforceable, the remaining provisions remain in effect. These Terms, together with any signed estimate or invoice and our Privacy Policy, are the entire agreement between you and Mikk Services, LLC regarding the Site and Services.
14. Changes
We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use after changes means you accept the updated Terms.
